Big Oil companies have knowingly fueled “catastrophic” climate damages for decades — but they lied about the danger to protect their profits. Now, as communities are taking action to make polluters pay, lawmakers want to give the fossil fuel industry blanket immunity from any laws or lawsuits that could hold them accountable for climate damages.

The Threat

  • Republican lawmakers

    have introduced bills in the U.S. Senate (S.4340) and U.S. House (H.R.8330) to give fossil fuel companies sweeping legal immunity from any laws or lawsuits that could hold them accountable for their role in the climate crisis.

  • Lame duck threat

    Republicans in Congress are preparing to push through a “giant” bill before the end of the year to pass all of the party’s priorities — which could include immunity for Big Oil.

  • State-level immunity bills

    for the fossil fuel industry are being introduced and passed in a growing number of states  as part of the larger coordinated effort to strip communities of their right to take Big Oil to court.

  • ALEC

    the fossil fuel-linked American Legislative Exchange Council (ALEC) is pushing model state legislation to create a “liability shield” that would give Big Oil companies “immunity" from climate lawsuits.

  • The American Petroleum Institute

    — the largest oil and gas lobbying group in the U.S. — announced that stopping state climate lawsuits and climate superfund laws is one of their top legislative priorities in 2026.

  • Sixteen Republican attorneys general

    even proposed a game plan for how the Trump administration could help create a “liability shield” for fossil fuel companies — modeled on the shameful 2005 law protecting gun manufacturers from lawsuits.

Who is saying No Immunity for Big Oil?

The fossil fuel industry spent decades lying to the public about the harms of its products and now they are pushing their allies in Congress to swoop in at the final hour and shield them from facing any accountability for fueling the climate crisis.

No industry should be above the law, especially not Big Oil.
